§1 Scope
These General Terms and Conditions (GTC) apply to all deliveries from pironex GmbH via https://shop-pironex.de/ (hereinafter referred to as the online shop) to consumers.
A consumer is any natural person who concludes a legal transaction for a purpose that cannot be attributed predominantly to their commercial or independent professional activity. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.
The following applies to entrepreneurs: If the entrepreneur uses conflicting or supplementary general terms and conditions, their validity is hereby contradicted; they will only become part of the contract if we have expressly agreed to this.
§2 Product Safety

(2) The product safety officer of pironex GmbH is responsible for compliance with the product safety-related requirements and for monitoring the corresponding processes.
(3a) The contractual partner (customer, supplier, dealer or service provider) shall ensure that its responsible employees or agents have the necessary qualifications and experience to perform product safety-related tasks in accordance with the applicable standards.
(3b) The contractual partner (customer, supplier, dealer or service provider) undertakes to immediately notify in writing of any violations of product safety-related requirements and to initiate appropriate measures to remedy the violations.
(4) The contractual partner (customer, supplier, dealer or service provider) shall be liable for damages resulting from non-compliance with product safety-related obligations, insofar as they are attributable to him.
§3 Contracting parties

§4 Conclusion of contract
(1) The presentation of the products in the online shop does not constitute a legally binding offer, but merely an invitation to order.
(2) You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained in the ordering process.
(3) By clicking the button “order with payment” you place a binding order for the goods contained in the shopping cart.
(4) The contract is concluded when you accept the offer for the goods contained in the shopping cart by clicking on the order button.
(5) The purchase contract in our online shop is concluded exclusively in German.
§5 Prices and shipping costs
(1) The prices stated on the product pages include the applicable statutory value added tax.
(2) In addition to the prices stated, we charge a flat rate of EUR 4.99 for delivery within Germany for orders under EUR 149.00. The shipping costs will be clearly communicated to you on the product pages, in the shopping cart system and on the order page.
For orders over 149.00 euros your delivery is free of charge.
(3) For deliveries to Switzerland, a flat shipping fee of 13.00 euros will be charged.
(4) The goods are shipped as standard delivery via DHL. We, as the online shop, bear the shipping risk.
(5) In case of cancellation, you as the buyer have to bear the direct costs of returning the goods.
§6 Delivery and availability of goods
Delivery is only possible within Germany. Articles are only sold in normal household quantities and only to end users.
The delivery time is up to 4 working days. We will indicate any differing delivery times on the respective product page or in the order confirmation.
§7 Payment
In our shop you can generally use the following payment methods:
payment via PayPal
Payment is made via the payment service provider PayPal, which handles payment processing via PayPal (Europe) S.à rl et Cie, SCA, 22-24 Boulevard Royal, L-2449 Luxembourg, subject to the PayPal terms of use, which can be viewed at www.paypal.com.
credit card
You enter your credit card details during the ordering process. Your card will be charged immediately after you place your order.
Google Pay
In order to pay the invoice amount via the payment service provider Google Ireland Ltd., Gordon House, Barrow Street, Dublin 4, Ireland ("Google"), you must be registered with Google, have activated the Google Pay function, authenticate yourself with your access data and confirm the payment instruction. The payment transaction will be carried out immediately after the order has been placed. You will receive further information during the ordering process.
Apple Pay
In order to pay the invoice amount via the payment service provider Apple Inc., One Apple Park Way, Cupertino, CA 95014, USA ("Apple"), you must use the "Safari" browser, be registered with Apple, have activated the Apple Pay function, authenticate yourself with your access data and confirm the payment instruction. The payment transaction will be carried out immediately after the order has been placed. You will receive further information during the ordering process.
Klarna invoice

Sofortüberweisung
We also offer instant transfer. We receive the transfer credit immediately. This speeds up the entire ordering process. All you need is your account number, bank code, PIN and TAN. Using the secure payment form from Sofort AG, which is not accessible to retailers, instant transfer automatically sets up a transfer in your online bank account in real time. The purchase amount is transferred immediately and directly to the retailer's bank account. If you choose the instant transfer payment method, a pre-filled form opens at the end of the ordering process. This already contains our bank details. The transfer amount and the intended purpose are also displayed on the form. You now have to select the country in which you have your online banking account and enter the bank code. Then enter the same data as when you registered for online banking (account number and PIN). Confirm your order by entering the TAN. You will receive confirmation of the transaction immediately afterwards. In principle, any Internet user can use instant transfer as a payment method if they have an activated online banking account with a PIN/TAN procedure. Please note that Sofortüberweisung is not yet available at a few banks. §8 Retention of title
The goods remain the property of pironex GmbH until full payment has been made.
§9 Warranty and Guarantee
If delivered items have obvious material or manufacturing defects, including transport damage, please complain about them immediately. To the transport service provider's employee directly upon delivery or write us an email to kundenservice@pironex.com. Your legal claims for all defects in our devices/delivered products that occur during the statutory warranty period of two years are the legal claims for defect rectification or replacement delivery.
§10 Dispute Resolution
The EU Commission has created an internet platform for online dispute resolution. The platform serves as a contact point for the out-of-court settlement of disputes concerning contractual obligations arising from online sales contracts. Further information is available at the following link: http://ec.europa.eu/consumers/odr. We are neither willing nor obliged to participate in a dispute resolution procedure before a consumer arbitration board.
§11 Right of Withdrawal
If you are a consumer (i.e. a natural person who places the order for a purpose that cannot be attributed to your commercial or independent professional activity), you have a right of withdrawal in accordance with the statutory provisions.
If you as a consumer make use of your right of withdrawal in accordance with section 4.1, you must bear the regular costs of return.
